Data processing agreement

This data processing agreement is based on the NLdigital Model Data Processing Agreement. It applies when AGTT B.V. processes personal data through Stokly on behalf of your organisation.

1. Roles

Your organisation is the controller. AGTT B.V. is the processor. Organisations that share a count each remain responsible for their own data.

2. Subject and duration

The processing consists of hosting and processing counts: stock lists, scans, photos, attachments, questions and answers. This agreement applies for as long as we process data for your organisation.

3. Types of data and data subjects

Names and email addresses of users and contacts; plates and VINs; photos with time and GPS location; data in stock lists. Data subjects are employees of your organisation and of your clients, and possibly owners or users of vehicles.

4. Instructions

We process the data only on your instructions, as laid down in this agreement and by the way you use Stokly, unless the law requires otherwise.

5. Security

We take appropriate technical and organisational measures. A description is on the Security page and forms part of this agreement.

6. Subprocessors

You consent to the subprocessors on our subprocessor list. We inform you in advance about a new subprocessor; you can object.

7. Data breaches

We report a personal data breach without undue delay, and at the latest within 48 hours of discovering it, so that you can notify the Dutch Data Protection Authority within 72 hours.

8. Help with requests and audits

We help you with data subject requests and with a DPIA. You may have compliance audited once a year, at your own cost, after reasonable notice.

9. End

After the agreement ends you can export your data. We then delete it within the periods in the privacy policy, unless the law requires us to keep it.
